WEDWORDS CUSTOM CROSSWORD PUZZLE PURCHASE TERMS AND CONDITIONS
By purchasing a custom crossword puzzle from WedWords, the Client agrees to the following terms and conditions:
1. SERVICE DESCRIPTION: The Client is purchasing a bespoke or semi-custom crossword puzzle (“Puzzle”), which will be designed in accordance with the product details provided in the WedWords Price List and Ordering Guide.
2. DESIGN AND CUSTOMIZATION: Upon order and initial payment for a Puzzle, WedWords shall send the Client a detailed questionnaire (“Design Questionnaire”) to inform the design of the puzzle. Upon Client’s completion and WedWords’ receipt of the completed questionnaire, WedWords will create a design proof for the Client's approval, subject to the terms herein.
3. PROOFS AND REVISIONS:
(a) SEMI-CUSTOM PUZZLES: WedWords will send the Client a draft of their crossword puzzle, including clues and answers, for the sole purpose of verifying the accuracy and spelling. The Client agrees to review and confirm the correctness of this content within three (3) days of receipt of the draft. Failure to provide timely approval may result in a postponement of the shipping date. WedWords shall not be held responsible for such delays. Once the Client has approved the draft, no additional changes or edits can be made.
(b) BESPOKE PUZZLES: WedWords will provide the Client with a comprehensive design proof of the bespoke crossword puzzle. The Client will have seven (7) days to offer feedback and request changes on any aspect of the puzzle's clues, design, and overall aesthetic. WedWords will undertake one round of revisions based on the Client's feedback at no additional cost and provide an updated design proof. Should the Client request further alterations following the initial round of complimentary revisions, such requests will be accommodated at an additional fee of $150 per hour. The Client agrees to this rate and acknowledges that any additional revisions will be billed accordingly and must be paid in full prior to the final delivery of the bespoke crossword puzzle.
4. PAYMENT: The Client agrees to the payment terms as outlined in the Price List and Ordering Guide, including a 50% deposit upon ordering and the balance due upon final proof approval. Any applicable discounts or promotional offers will be applied to the remaining balance, which is to be paid prior to the final printing and delivery of the product. Semi-custom orders must be paid in full at the time the order is placed.
5. SHIPPING AND DELIVERY: The completed Puzzle shall be shipped to the Client within six weeks of questionnaire completion, subject to Client's timely responses and approval of proofs. Client should place order with enough time to allow for normal shipping delays. WedWords shall not be held responsible for delivery delays outside its control.
6. INTELLECTUAL PROPERTY: WedWords retains all rights to design elements and other intellectual property created, developed, or produced by WedWords in connection to the Puzzle. WedWords retains the right to use images of the Puzzle in all forms and media for advertising, trade, and any other lawful purpose.
7. PERMITTED USES: Client may use the Puzzle for the event and for personal, non-commercial purposes. Client may also use photographs and video of the Puzzle for personal, non-commercial purposes, including posting to social media and publication to wedding-related newspaper announcements or magazine articles. In all cases, Client must ensure that photographs and video attribute Puzzle design and production to WedWords.
8. CANCELLATION AND REFUNDS: If the Client cancels before submitting the final design approval, the deposit shall be forfeited. No refunds will be offered after final design approval. If WedWords cancels at any time, all monies paid will be refunded in full.
9. LIMITATION OF LIABILITY: WedWords is not liable for indirect or consequential damages. Liability is limited to the amount paid by the Client under this Agreement.
10. ACKNOWLEDGEMENT: The Client acknowledges that agreeing to these terms constitutes an agreement to the purchase and that this document supersedes all prior agreements and understandings regarding the purchase.
